Abstract

A doença de COVID-19, declarada como uma pandemia, provocou um tsunami a nível mundial afetando todos os Estados, incluindo Portugal, o que levou à declaração de estado de emergência e consequente encerramento de grande parte da economia neste País. O impacto legislativo de tal pandemia foi enorme, sendo que, no âmbito da legislação de segurança social portuguesa, tendo por referência a data da conclusão deste trabalho (8 de maio de 2020), a resposta jurídica produziu-se, essencialmente, através de duas leis para proteção dos trabalhadores. A primeira dessas leis aprovou medidas de excecionais e temporárias de proteção da contingência da incapacidade temporária de origem comum, e ainda, de proteção da família. A segunda grande resposta jurídica de segurança social aos efeitos da pandemia, deu-se pela aprovação de uma lei que concedeu apoios aos empregadores, para proteção do emprego, designadamente, para manutenção dos postos de trabalho. A produção normativa de segurança social foi extensa, no entanto, caraterizou-se pela adoção de algumas soluções incoerentes, do ponto de vista do sistema de segurança social, esquecendo alguns grupos de trabalhadores, mas também a proteção dos dependentes, que permanecem parcialmente esquecidos no sistema de segurança social português.

The COVID-19 disease, declared as a pandemic, has caused a worldwide tsunami affecting all States, including Portugal, which led to the declaration of a state of emergency and the consequent closing of a big part of the economy in this Country. The legislative impact of such pandemic was massive and within the scope of the Portuguese social security legislation, having as reference the date of the conclusion of this work (May 8, 2020), the legal response was produced, essentially, through two statutes on the protection of workers. The first of these statutes, approved the exceptional and temporary measures on protection of the contingency of the temporary incapacity of common origin, and also, on family protection. The second major legal response to the effects of the pandemic regarding social security, was the approval of a law that granted social support to the employers in order to protect employment, namely, to maintain jobs. The production of social security laws was extensive, however, it was characterized by the adoption of some incoherent solutions from the perspective of the social security system, leaving behind some groups of employees, but also the protection of dependents who remain partially forgotten in the Portuguese social security system.
