A expansão do teletrabalho: um olhar para o futuro das relações trabalhistas
Utilizando-se do método dedutivo como condutor da pesquisa, bem como do levantamento bibliográfico, o estudo aborda o teletrabalho nas estruturas organizacionais, bem assim os aspectos sociais que norteiam a implementação do regime de trabalho à distância. Expõe o teletrabalho como resposta ao impacto nas relações trabalhistas do distanciamento social imposto pela pandemia decorrente do coronavírus (Covid-19). Analisa as repercussões das normas já existentes sobre o teletrabalho, os normativos editados no período pandêmico e as lacunas que se apresentam no ordenamento jurídico. O estudo expõe o meio ambiente de trabalho sadio como direito fundamental. Por fim, conclui-se que as mudanças nas relações de trabalho que se estabeleceram principalmente no período pandêmico reivindicarão uma nova perspectiva de labor no período pós-pandemia, cabendo ao Direito reconhecer as mudanças e responde-las adequadamente. Using the deductive method as a conductor of the research, as well as the bibliographic survey, the study addresses teleworking in organizational structures, as well as the social aspects that guide the implementation of the distance work regime. It exposes teleworking in response to the impact on labor relations of the social distance imposed by the pandemic resulting from the coronavirus (Covid-19). It analyzes the repercussions of the existing rules on teleworking, the norms issued in the pandemic period and the gaps that appear in the legal system. The study exposes the healthy working environment as a fundamental right. Finally, it is concluded that the changes in labor relations that were established mainly in the pandemic period will demand a new perspective of work in the post-pandemic period, and it is up to the Law to recognize the changes and respond accordingly.
